Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and ProjectHax LLC, a Pennsylvania limited liability company ("ProjectHax," "we," "us"), governing your use of the Last Swipe mobile application and related services (the "Service"). By creating an account, signing in, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally able to form a contract. By using the Service you represent that you are 18 or older, are not prohibited by law from using dating services, and have never been convicted of a sexual offense. We may terminate any account we reasonably believe belongs to a person under 18.
2. Your account
Accounts are created with Sign in with Apple. You are responsible for all activity on your account and for keeping your device secure. Accounts inactive for 30 consecutive days are permanently and automatically deleted, including all photos, matches, and messages. You may delete your account at any time in Settings; deletion is immediate and irreversible.
3. Purchases
The Service is free with a daily swipe limit. A one-time "Unlimited Swipes" purchase is available through Apple's In-App Purchase system, is tied to your Apple Account, is restorable across devices and reinstalls, and is non-refundable except as required by Apple's policies or applicable law. All billing is handled by Apple; we never see your payment details. The purchase unlocks features within the Service for as long as the Service operates; it is not a promise that the Service will remain available (see Section 13).
4. License and our intellectual property
The Service — including the app, our servers and software, and all design, graphics, logos, and trademarks (excluding content you and other users submit) — is owned by ProjectHax and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the app on Apple-branded devices you own or control and to use the Service, solely for your personal, non-commercial use and in accordance with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Service; scrape, harvest, or bulk-download data from it; or reverse-engineer or attempt to extract its source code, except to the extent applicable law permits this despite the restriction. All rights not expressly granted to you are reserved by ProjectHax. This license ends when your account is deleted or these Terms terminate.
5. Your content
You retain ownership of the photos, text, and messages you submit. You grant ProjectHax a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit that content solely to operate the Service. You represent that you own your content, that it depicts you, and that it does not violate anyone else's rights.
6. Community rules and moderation
There is zero tolerance for objectionable content and for abusive users on Last Swipe.
You agree not to: post nude, sexually explicit, or otherwise objectionable content; harass, threaten, or abuse anyone; impersonate any person; use the Service for commercial solicitation, spam, or scams; use the Service while under 18; or attempt to interfere with the Service's operation.
Reporting and blocking. You can report or block any user from their card in the deck, from their profile, or from the menu in any conversation. Reporting someone also blocks them immediately: they disappear from your deck, you are unmatched, and neither of you can contact the other again. You can review and undo your blocks in Settings → Blocked people. You can also reach us any time at [email protected].
What we do about it. Photos are screened by an automated classifier before they ever appear on the Service, and a photo we cannot screen is not published. When a user is reported, we run further automated checks appropriate to the report, and a human reviews it. We act on reports of objectionable content or abusive behaviour within 24 hours — removing the content and suspending or permanently banning the account responsible where warranted. Content our systems confirm as explicit is taken down immediately, without waiting for that review.
We may remove content, refuse uploads, restrict features, or suspend or permanently ban accounts at our sole discretion, with or without notice. A banned account cannot be recreated. We are not obligated to monitor, but we reserve the right to.
7. Safety — no background checks
ProjectHax does not conduct criminal background checks or identity verification on users. You are solely responsible for your interactions with other users, both online and offline. Use caution: meet in public, tell someone where you're going, and never send money to anyone you meet on the Service. YOU UNDERSTAND THAT PROJECTHAX MAKES NO GUARANTEES ABOUT THE CONDUCT, IDENTITY, HEALTH, OR INTENTIONS OF ANY USER.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOU WILL FIND A MATCH, A RELATIONSHIP, OR ANYTHING ELSE; THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; OR THAT AUTOMATED MODERATION WILL CATCH ALL OBJECTIONABLE CONTENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROJECTHAX AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATING TO THE SERVICE OR YOUR INTERACTIONS WITH OTHER USERS — INCLUDING OFFLINE CONDUCT — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF FIFTY DOLLARS (US $50) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify, defend, and hold harmless ProjectHax from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your conduct toward other users, or your breach of these Terms.
11. Arbitration and class-action waiver
Any dispute arising out of these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Pennsylvania. YOU AND PROJECTHAX EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION. Either party may instead bring an individual claim in small-claims court. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms.
12. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Any claims not subject to arbitration shall be brought exclusively in the state or federal courts located in Pennsylvania.
13. Changes, termination, and shutdown
We may update these Terms; material changes will be presented in-app for re-acceptance and the version date above will change. We may suspend or terminate the Service or your access to it at any time, including for any violation of Section 6.
We may also modify, discontinue, or permanently shut down the Service, in whole or in part, at any time and for any reason, including commercial ones. If we shut down the Service entirely, we will make reasonable efforts to give you at least 30 days' advance notice in-app or by push notification, unless a shorter period is required by law, security, or events beyond our reasonable control. On shutdown, all accounts and their data are permanently deleted as described in the Privacy Policy. The Unlimited Swipes purchase unlocks features only while the Service operates; if the Service is discontinued, you will not be entitled to any refund or other compensation, except as required by Apple's policies or applicable law. Sections 4, 5, 8–12, and 14 survive any termination of these Terms or shutdown of the Service.
14. General
Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and ProjectHax regarding the Service and supersede all prior or contemporaneous agreements and understandings about it. Assignment. You may not assign or transfer these Terms or your account; any attempt is void. We may assign these Terms without your consent to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets, and these Terms bind and benefit the parties' permitted successors and assigns. Severability. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will stay in full force. No waiver. Our failure or delay in enforcing any provision is not a waiver of our right to enforce it later; a waiver is effective only if in writing and signed by us. Force majeure. ProjectHax is not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, government action, epidemics, power or internet outages, or failures of third-party services such as Apple or our hosting providers.
15. Apple
Last Swipe is distributed through the Apple App Store, and the following applies to that distribution.
These Terms are between you and ProjectHax only, not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation of any kind with respect to the app.
Apple is not responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product-liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation. Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app infringes that third party's intellectual-property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of them.
